Overview

Identifying failures of the system to adjust for changing circumstances for sentencing non-production child pornography offenders utilizing the 2021 US Sentencing Commission Report.

Summary

In June of 2021, the US Sentencing Commission Report was released based on their study of Federal Sentencing of Child Pornography Non-Production Offenses. The report clearly states that this is a follow up to the 2012 US Sentencing Commission Report.

The recommendations of the 2012 report were not adopted.

One of the main suggestions made in 2012 was that the sentencing scheme should be revised. The reasoning was to account for changes in technology and the scientific data published regarding recidivism and community risk.
