In many jurisdictions, there is an increasing number of individuals with Autism Spectrum Disorder being charged with sexual crimes. While we know that these individuals are very different from those not on the spectrum, there is still limited research on the issue.

Summary

Magari et. al. (2024) published a systematic review of ASD and sexual offending in Neuroscience and Biobehavioral Reviews in 2024. The goal of this research was to do the following:

Overview

As I have written previously, we are seeing more individuals with Autism Spectrum Disorder in criminal cases. Research and assessment for individuals with ASD is lagging behind this increase.

Summary

This study, published in 2023 in the Revista Espanola de Sanidad Penitenciaria, specifically looked at ASD in the prison system via a systematic review of 14 peer reviewed scientific articles published in journals.

Findings of the Study on Autism Spectrum Disorder in Prison

Analyzing the articles revealed that many inmates diagnosed with Autism Spectrum Disorder also present with self-harm. They also exhibit higher rates of disruptive behavior in jail.  There are currently no assessment tools validated with ASD individuals to assess a predisposition for violent or disruptive behavior. Whether that behavior is directed internally or externally.

Overview

As the number of individuals who are on the spectrum and are charged with or convicted of a sex crime increases, it becomes critically important for all who work with these individuals in the system, from evaluators to probation officers, to be educated specifically about sex crimes, autism and male sexuality. 

Summary

This 2017 study published in the journal, Autism, specifically explored how adolescent boys on the ASD spectrum experience sexuality.

Methodology

This is a qualitative study that uses interpretative phenomenological analysis to collect and analyze the study data. 

The study involved 8 men between the ages of 16 and 20 who had all previously been diagnosed with ASD. 

The men were interviewed by the researchers and asked a set of questions relating to sexuality.  

The data analysis revealed three main themes: 

  • Developing Sexual Self
  • Interpreting sexuality related information from my surroundings
  • Exploring relationships and partnered sex

    Summary

    While this article, written and privately published by Attorney Mahoney, is older (2009), its contents are still extremely relevant today.

    The number of individuals with Autism Spectrum Disorder (ASD) involved in the criminal justice system is not decreasing, and anecdotally, appears to be increasing.

    Syptoms of ASD: Autism and the Law

    In his article, Mr. Mahoney lays out the primary symptoms of ASD. Here’s a brief overview of these symptoms:

    • Difficulty in understanding the perspective of others, often called Mind blindness or struggles with Theory of Mind
    • Delays in social and emotional development
    • Lack of understanding of socially expected behavior and norms
    • Intense focus on certain topics or behaviors.

    Autism and the Law: How does Autism play out in the criminal justice system?

    The crux of this article is how do ASD symptoms play out in the criminal justice system when accused of a sexual offense.

    Summary

    It is well known that most criminal cases plead out and do not go to trial. However, this is not the case for all criminal matters. In any trial, the jury plays a key role in the outcome.

    An Article Looking at Autism at Trial

    In a 2021 article in the University of Pittsburgh Law Review, Perlin and Cucolo lay out the ways in which a jury may misconstrue an autistic client. They evaluate how this can affect the case and how a trial attorney can help mitigate these issues.

    Understanding ASD

    One of the first statements this article makes:

    In order for an attorney to meet the effectiveness of counsel standard, they must have some familiarity with the clinical diagnosis of Autism Spectrum Disorder (ASD) and how society perceives these individuals.
